These Terms & Conditions ("Terms") govern your access to and use of the websites, applications, and services operated by EdKairos, Inc. ("EdKairos," "we," "us," or "our"), including the EdKairos math intelligence platform and the free diagnostic (collectively, the "Service"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is intended for parents, guardians, educators, and adult learners. If the Service is used on behalf of a child under 18, a parent or legal guardian must create and control the account and consents to the child's use. By using the Service on behalf of a minor, you represent that you are the parent or guardian with authority to do so.
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
EdKairos offers a free math diagnostic that identifies a learner's skill gaps and produces a plain-English report. The diagnostic and its report are provided for informational and educational purposes. Results are estimates designed to align with common benchmarks and are not a clinical, psychological, or official educational assessment.
You agree not to misuse the Service, including by attempting to access it in an unauthorized way, reverse-engineering it, reselling access, uploading unlawful or infringing content, or using it to harm others. We may suspend or terminate accounts that violate these Terms.
The Service, including its content, software, diagnostics, generated items, figures, and reports, is owned by EdKairos or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service for your and your household's personal, non-commercial educational use. All other rights are reserved.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms. EdKairos is built to protect student data and to support compliance with applicable privacy laws, including FERPA and COPPA where relevant. We do not sell personal information, serve targeted advertising, or use student personal information to train third-party AI models.
For schools and districts: where the Service is deployed by a school or district, EdKairos acts as a school official under FERPA, under the school's direction and control, and a signed Data Privacy Agreement (for example, the SDPC / A4L National DPA) governs and controls over any conflicting term in these Terms. District and student accounts are not charged consumer subscription fees under Section 4 and receive no marketing text messages; the consumer plan, referral, and SMS terms in Sections 4, 8, and 14 apply only to direct-to-parent accounts.
If you provide your mobile number and opt in, EdKairos may send recurring automated marketing and informational text messages (such as diagnostic reminders, results, plan information, checkout follow-ups, and educational tips) to the number you provide. You must be at least 18 years old to opt in to receive text messages. Consent to receive texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and get help by replying HELP. We do not share or sell mobile opt-in information or SMS consent to third parties or affiliates for their marketing purposes. Carriers are not liable for delayed or undelivered messages. This applies only to adult (18+) direct-to-parent accounts that opt in; it does not apply to school or district deployments or to student accounts, which receive no marketing text messages. The Service is provided "as is" and "as available." EdKairos is an educational tool and does not guarantee any particular academic outcome, score, or result. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, EdKairos and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid EdKairos in the twelve months before the event giving rise to the claim.
We may modify the Service or these Terms. If we make material changes, we will provide notice (for example, by posting an updated date or notifying you). Your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Georgia, unless applicable law requires otherwise.

Active EdKairos subscribers may share a personal referral link. You earn one (1) free month of your then-current subscription — applied as a credit to your next due payment — for each qualified referral, up to a maximum of three (3). A referral is qualified when the referred person (a) is a new EdKairos customer using a separate billing account, and (b) completes their first paid subscription payment through your referral link. Rewards are issued as account credit toward a future invoice, have no cash value, and are non-transferable. Self-referrals, duplicate or fraudulent accounts, and payments later refunded or charged back do not qualify and may be reversed. EdKairos may modify, suspend, or end the referral program, or revoke rewards obtained through abuse, at any time. You are responsible for any applicable taxes on rewards.
